GENERAL TERMS AND CONDITIONS OF SALE

  1. Introduction

The general terms and conditions of sale set out below (hereinafter the “General Terms”) exclusively govern contractual relations between any user of saboulautosport.com (hereinafter “user”, “you”, “customer” or “consumer”) and the merchant Saboul Auto Sport, owned by SABOUL AUTO SPORT (hereinafter “SABOUL AUTO SPORT” or “we”). These are the only applicable general terms of sale and replace all other terms unless SABOUL AUTO SPORT has expressly agreed otherwise in writing beforehand. SABOUL AUTO SPORT may occasionally amend certain provisions of its General Terms; you should therefore read them again before each visit to www.saboulautosport.com (hereinafter the “Website”). These amendments are binding from publication and do not apply retrospectively. Each purchase www.saboulautosport.com is governed by the general terms of sale applicable on the order date. By confirming your order, you are considered to have read and unreservedly accepted our general terms of sale. By accessing the Website, you undertake to comply with the General Terms and Terms of Use. These general terms of sale remain available via www.saboulautosport.com in electronic formats that can be printed, allowing consumers to reproduce or save them. SABOUL AUTO SPORT undertakes to comply with all provisions of the French Consumer Code concerning distance selling.

  1. Placing an order

To place an order, 24 hours a day, 7 days a week, visit our website: www.saboulautosport.com Once you have made your selection and confirmed your basket, you must identify yourself, choose your delivery method and select a payment method. You must then pay for your order, which definitively formalises the sales contract between you and SABOUL AUTO SPORT.

  1. Product information

SABOUL AUTO SPORT takes great care when publishing information about its products and their uses, particularly technical descriptions and product photographs, within technical limitations and in line with the best market standards (photographs are not contractually binding).

  1. Product use

SABOUL AUTO SPORT sells used and new products for performance vehicles. SABOUL AUTO SPORT cannot be held liable for misuse, including driving that breaches road traffic rules or vehicle modifications that make a vehicle non-compliant for use on public roads.

  1. Prices

The selling prices shown on www.saboulautosport.com are displayed in euros, excluding delivery charges. VAT applies in certain cases (Special Scheme: Second-Hand Goods). Any delivery charges are shown in the order summary and charged at checkout in addition to the price of the selected products. These charges depend on the items selected. SABOUL AUTO SPORT may occasionally cover all or part of the delivery charges within a defined offer.

  1. Promotional codes

These are offered occasionally in newsletters, the press and through SABOUL AUTO SPORT partners. Their use is subject to conditions: codes are valid only for the products specified on www.saboulautosport.com. Each code is valid for one use on a specific occasion and is non-refundable. Promotional codes and vouchers cannot be combined. To receive the discount, the code must be entered in the designated field when placing the order on the Website. If you forget, we cannot cancel or recreate the order to apply the promotion. Promotional codes are valid only during the periods specified in the offer in newsletters, the press or through our partners. They are not valid during sales periods or for made-to-order purchases referred to as “private sales”.

  1. Availability

We process orders subject to stock availability. If an ordered product is unavailable, we undertake to contact you by email within 2 days of your order date, informing you and indicating when the product could be delivered, where applicable.

  1. Secure payment

Payment is available by card through Monetico, by PayPal for eligible products, or by bank transfer. Only options available for the basket are displayed at checkout. Bank transfers must be received before preparation dependent on payment. See Secure payment.

  1. Delivery

Small parcels are shipped by DPD, La Poste or Chronopost; bulky goods by freight carrier Heppner. A tracking email is sent, including for direct supplier shipments. Availability, lead-time information and delivery charges are provided before the order is confirmed. See Delivery & lead times. Statutory rights in the event of delay, loss or non-delivery remain applicable; the seller remains responsible as required by law.

  1. Receipt of goods

Please check the packaging and contents and report any damage or error promptly, with photos where possible. Reservations to the carrier help us investigate. Failing to make reservations or report an issue within three days does not remove statutory consumer rights. See Returns & refunds.

  1. Liability

SABOUL AUTO SPORT cannot be held liable for failure to perform a contract due to force majeure, including full or partial strikes affecting postal services or carriers, or disasters caused by flooding or fire. SABOUL AUTO SPORT accepts no liability for indirect damage arising from these causes in relation to products bought for professional use, including operating losses, lost profit, damage or costs. The choice and purchase of a product or service are solely the customer's responsibility. A complete or partial inability to use our products, particularly because of hardware incompatibility, cannot give rise to compensation, refund or liability for SABOUL AUTO SPORT, except where a latent defect, non-conformity or product defect is established.

  1. Retention of title

Products remain the property of SABOUL AUTO SPORT until full payment has been received and the customer has received the order.

  1. Non-registration of an order

SABOUL AUTO SPORT reserves the right not to register a payment and therefore not to confirm an order for any reason, particularly supply or delivery issues foreseeable when the order is placed. The customer will be informed by any means within two working days of the order date. Non-performance or partial performance of an order does not entitle the customer to compensation.

  1. Withdrawal

Consumers generally have 14 days from receipt to notify withdrawal, then 14 days to return the goods. Statutory exceptions apply, notably to goods made to specifications or clearly personalised. Prior authorisation is not required. Refunds, including applicable standard outbound delivery costs for full withdrawal, are made within 14 days of notification, subject to the right to withhold until receipt of the goods or proof of return dispatch, whichever is earlier. The original payment method is used unless expressly agreed otherwise at no cost. No PayPal commission is deducted.   1. Complaints & returns

Contact us with your order reference, the items concerned and the nature of the request. A change-of-mind return must be distinguished from an incorrect, damaged or faulty product. Statutory conformity remedies are free of charge for consumers. Handling beyond what is necessary to check the goods may give rise to a deduction for diminished value, as permitted by law. Data uses, recipients, retention and individual rights are explained in the Privacy & personal data policy. Closing an account does not delete records that must be retained by law.

  1. Applicable law and competent jurisdiction

The contract between the customer and SABOUL AUTO SPORT is governed by French law. Any dispute concerning it is subject to the exclusive jurisdiction of the courts.

  1. Warranty

Consumers benefit from the statutory conformity guarantee under Articles L217-3 et seq. of the French Consumer Code and the hidden-defects guarantee under Articles 1641 et seq. of the French Civil Code, under their respective conditions. Statutory guarantees also apply to second-hand goods. They do not depend on a manufacturer’s commercial approval and are not generally excluded simply because a product is intended for competition. Describe any issue to us so that the appropriate procedure can be arranged.

In the event of a dispute, consumers are invited to contact Saboul Auto Sport first to seek an amicable solution. If it remains unresolved, and following a prior written complaint, the customer may contact the Mediator of the French National Council of Automotive Professions (CNPA):
